That all depends on what type of rights deal Depp made and how long it was to last. Chances are it was only for a theatrical film or maybe films (sometimes a sequel needs to be renegotiated) - and considering he made the deal in '07, chances are pretty good that Depp's deal has already expired. But at any rate, it probably didn't include TV rights, so someone should be able to negotiate those.
Also, in my last post I forgot to mention that the distribution rights for the original series changed hands a few years ago. Worldvision no longer holds them as now DS is handled by CBS Television Distribution, which is why their logo is the one that's been seen at the end of every ep shown on Decades.
Actually, it wasn't Tim Burton who secured the rights to make the Depp/DS film - it was Johnny Depp. DC was still alive when the negotiations started, but they were finalized by his estate. And Burton didn't come on board the project until months after the rights deal had been made...
If BtVS really was the most popular horror film that year, then that's a sad commentary on 1992's horror films because compared to the brilliant TV series, that film was just awful. Even Joss Whedon disavows the film (mostly because of studio interference - but so what else is new).
