Who 'Owns' DS?

Alot of things couldn't be done while Dan Curtis was still alive.

Who 'owns' Dark Shadows now?

And, is it in different parts; (the TV series, the IP, the characters)?

I'm asking, because why wouldn't it be on Netflix et al.?

I have no idea if 'someone' gets money for their show or movie being on Net/Hulu/Prime.

Does anyone know?

I believe that Dan Curtis' estate owns the rights to the original series and characters, and probably also the 1991 revival series.  MPI holds the rights for home video release of the original series.  Warner owns the rights to the movies, at least as far as distribution goes; I'd bet it's quite possible that the DC estate might own the actual IP (that is, someone wanting to do a remake would probably have to go through DC and not Warner).

And yes, absolutely rentals have to be paid to one entity or another for showing the series or movies in theaters, broadcast, or streaming.  None of it is in public domain, or will be for a long time.  That's why DS can be hard to find on TV--the networks or stations need to make the necessary agreements and payments to the distributors.

A series like the original DS can be a difficult one to market, because it's a continuing series that lasts almost 5 years, and does not at all lend itself to occasional viewing--you need to see the episodes in sequence, ideally not missing any, during the major story arcs.  It's much easier to program series in which each episode is a more-or-less standalone story.  Furthermore, if a network shows the pre-Barnabas episodes, they risk alienating viewers who cannot relate to them as being DS (because those poor unfortunate souls have been led to believe the show was always and only about vampires and witches and such).

I hadn't thought about it being hard with a 'serial' type show; it makes sense, and yea, the 'average' viewer doesn't know DS w/out Barnabas.

Actually, it wasn't Tim Burton who secured the rights to make the Depp/DS film - it was Johnny Depp. DC was still alive when the negotiations started, but they were finalized by his estate. And Burton didn't come on board the project until months after the rights deal had been made...

at this point i think it's safe to assume any "sequels" to the Depp/Burton iteration are off the table...


can anyone else remake the "property" or is it still tied up in the D/B deal? what if someone wanted to make another TV series?

That all depends on what type of rights deal Depp made and how long it was to last. Chances are it was only for a theatrical film or maybe films (sometimes a sequel needs to be renegotiated) - and considering he made the deal in '07, chances are pretty good that Depp's deal has already expired. But at any rate, it probably didn't include TV rights, so someone should be able to negotiate those.

Also, in my last post I forgot to mention that the distribution rights for the original series changed hands a few years ago. Worldvision no longer holds them as now DS is handled by CBS Television Distribution, which is why their logo is the one that's been seen at the end of every ep shown on Decades.

Worldvision no longer exits. A while back (I forget the exact year) they were taken over by Paramount Domestic Television, and then when CBS merged with Paramount, all of Worldvision's shows then became part of CBS Television Distribution. Interestingly, all that means that both DS and Star Trek have the same distributor now.

The OS series was on ABC.  Then the '91 remake was on NBC.  Now it's owned by CBS.  WB tried its '04 remake and picked the wrong show and went into the dumps.  What's next?  Fox?  Imagine Homer Simpson or Bill O'Reilly playing Roger.

DC already tried to get a DS pilot made for FOX, but it never got past the script phase...
